The DGB Holiday Spirits Promotion (“Promotion”) is presented by DGB (PTY) LTD. Registration number 1946/021311/07 and/or its agencies (“Organizer”).  All Consumers during the time of these Promotions agree to be bound by the following Terms and Conditions:

  1. Promotion Period: 
    1. The Promotion shall commence from 18 October 2021 to 31 December 2021 on the selected qualifying products (“The Promotion Period”). 
    2. The Participant will have from 18 October 2021 to 31 December 2021 to enter and complete registration via the registration platform (‘the Entry Period”). 
    3. The duration of the promotion may be extended or shortened at the discretion of DGB or the Organizer. 

  2. Eligibility  
    1. To enter, all Participants must meet the following requirements: 
      1. Be citizens and/or a legal resident of the Republic of South Africa and be currently residing in the Republic of South Africa at the date of the commencement of the Promotional Period. 
      2. Be a natural person and be at least 18 years old at the date of the commencement of the Promotion Period. 
      3. Be in possession of a valid proof of purchase of the Qualifying Products with verifiable details.

  3. How to Qualify for the Promotion:
    1. The Participant must: 
      1. Purchase at least one of any of the following Qualifying Products: 
      2. Tant Sannie
      3. Strawberry Lips
      4. PO10C
      5. Tang Apple
      6. Tang Cherry
      7. Wild Peach
      8. Zappa

        The proof of purchase (till slip) must be retained by the Participant for verification purposes as evidence of the purchase of the Qualifying Products. 

  4. How to enter the Promotion 
        1. To stand a chance to win a prize, the Participant must purchase one of the participating products in-store and enter via the registration web link www.holidayspirits.co.za.
        2. The participant must visit the registration web link and complete the following:
          1. Accept the Terms & Conditions
          2. Confirm age via the age gate
          3. Provide mobile number
        3. Participants are sent an SMS with OTP to validate their mobile number and get access to the registration platform. Participants are limited to a maximum of 20 entries per mobile number over the Promotion Period.
        4. Once on the registration platform, Participants are required to enter the following registration details:
          1. Name & Surname
          2. Date of Birth
          3. Date of Purchase of Qualifying Products 
          4. Upload an image of their till slip and submits entry. 
        5. Winning entries are randomly selected and allocated a choice reward to the value of either R100 (One Hundred Rand), R250 (Two Hundred and Fifty Rand), R500 (Five Hundred Rand), R750 (Seven Hundred and Fifty Rand), R1000 (One Thousand Rand), R2500 (Two Thousand Five Hundred  Rand) or R5000 (Five Thousand Rand); and the Participant will be notified instantly whether their entry is a winning or non-winning entry. 
        6. All winning entries will then be verified and validated as eligible. The verification period will take up to 3 (three) working days from the date of the completed entry. If the contents of the participant’s entry have been received and found incorrect/ incomplete for whatever reason, the participant will not receive their prize. The responsibility to provide the correct information rests with the participant. 
        7. Once verified as a valid winning entry, winning participants will receive an SMS with a unique pin code and redemption platform access to select and redeem their choice reward. The following applies: 
          1. The unique pin code sent to the participant will be valid for 30 (thirty) days from date of issue. The participant must redeem their choice reward within this period, or it is forfeited. 
          2. Once the participant has logged onto the Redemption Platform, they will be able to choose and redeem their choice reward to the value allocated to them per clause 4.5. 
        8. Participants stand a chance of winning a choice reward consisting of 4 prizes (of various denominations).
        9. Participants will have a choice of either Takelot.com coupons; Sorbet digital vouchers; Mr D Food coupons or Flight Centre digital vouchers. Each prize has its own additional conditions. 

  5. Prizes: 
    1. TAKEALOT.COM COUPON
      • The Takealot coupon entitles the participant to either a R100 (One Hundred Rand), R250 (Two Hundred and Fifty Rand), R500 (Five Hundred Rand), R750 (Seven Hundred and Fifty Rand), R1000 (One Thousand Rand), R2500 (Two Thousand Five Hundred  Rand) or R5000 (Five Thousand Rand) Takealot.com coupon depending on the value of the reward assigned to the participant per clause 4.5, with the following conditions:
        • Only available for use on the Takealot.com website towards the purchase of products found on www.takelot.com.
        • Takealot.com coupons are valid until 28 February 2022.
        • If a Takealot.com coupon has not been used within that period, it will expire and be forfeited.
        • Coupons cannot be used to buy Gift Vouchers or other coupons and cannot be exchanged or refunded for cash. Takealot is not responsible for any harm due to the loss, unauthorized use or distribution of a coupon.
        • They can only be used once.
        • Only one coupon can be used per order
        • A unique coupon code can only be used once per promotion
        • Takelot.com coupons may not be used in conjunction with any other reward, coupon, voucher or discount.
        • A coupon must be used at check-out – it cannot be used later on existing orders.
        • The value of the coupon will be set off against the value of your shopping basket, if the value of the basket is higher than the value of the coupon, you will be required to pay in the difference. If the value of the basket is less than the value of the coupon, you will forfeit the remaining value of the coupon.
        • Takelot.com Coupons do not accrue interest and are not refundable for cash once purchased.
        • Takealot.com is not responsible for any harm due to the loss, unauthorized use or unauthorized distribution of a Takealot.com coupon, after it has delivered the Takealot.com coupon to you or the email address nominated by you.
        • If for any reason a coupon does not reflect on the final amount due from you at check-out, you can contact Takealot.com on (https://secure.takealot.com/help) to confirm if the Coupon is still valid. If Takealot.com confirms that the coupon is still valid and you have already placed your order, you can choose whether to cancel the order and place it again with the coupon, or you can use the coupon on your next order within the limitations of the specific coupon’s terms and conditions.
        • This campaign is no way sponsored, endorsed or administered by, or associated with Takealot.com.

    2. SORBET VOUCHER
      • The voucher entitles the participant to a Sorbet voucher to the value of either R100 (One Hundred Rand), R250 (Two Hundred and Fifty Rand), R500 (Five Hundred Rand), R750 (Seven Hundred and Fifty Rand), R1000 (One Thousand Rand), R2500 (Two Thousand Five Hundred  Rand) or R5000 (Five Thousand Rand) depending on the value of the reward assigned to the participant per clause 4.5, with the following conditions:              
        • The voucher is valid for 3 (three) years.
        • The voucher cannot be exchanged for cash or credit.
        • The remaining value of the voucher will stay on the voucher until redeemed. 
        • No cash balance will be given as change.
        • The voucher value will remain until the balance is either depleted or the expiry date is reached, whichever occurs first.
        • The voucher cannot be replaced if lost or stolen.
        • The voucher is valid at any Sorbet Salon, Sorbet Drybar, Sorbet Nail bar, Sorbet Man, Sorbet Skin venues or standalone Candi & Co. nationwide. 
        • The voucher may be used on the Sorbet App.
        • Sorbet vouchers are subject to Sorbet’s regular terms and conditions (https://www.sorbet.co.za/product/customize-your-gift-card/), which are subject to change, unless otherwise specified in this section

    3. FLIGHT CENTRE VOUCHER
      • The voucher entitles the participant to a Flight Centre voucher to the value of either R100 (One Hundred Rand), R250 (Two Hundred and Fifty Rand), R500 (Five Hundred Rand), R750 (Seven Hundred and Fifty Rand), R1000 (One Thousand Rand), R2500 (Two Thousand Five Hundred  Rand) or R5000 (Five Thousand Rand) depending on the value of the reward assigned to the participant per clause 4.5, with the following conditions:
        • The Participant must book their travel within 30 (Thirty) days of redeeming their Flight Centre reward voucher. Participants must then travel within 6 (Six) months of redeeming their voucher. 
        • The voucher cannot be exchanged for cash or credit.
        • If the value of the purchase is less than the value of the voucher you will forfeit the remaining value of the voucher.
        • If the value of the purchase is more than the value of the voucher you will be required to pay in the difference.

    4. MR D FOOD WiCode
      • The WiCode entitles the participant to a Mr D Food WiCode to the value of R100 (One Hundred Rand), R250 (Two Hundred and Fifty Rand), R500 (Five Hundred Rand), R750 (Seven Hundred and Fifty Rand), R1000 (One Thousand Rand), R2500 (Two Thousand Five Hundred  Rand) or R5000 (Five Thousand Rand) depending on the value of the reward assigned to the participant per clause 4.5, with the following conditions: 
        • The WiCode is valid for 1 (one) year.
        • The WiCode cannot be exchanged for cash or credit.
        • Should the full value of the reward not be utilised upon purchase, the participant will forfeit the balance of the reward amount. Or alternatively, please email vouchers@mrdfood.com if a credit needs to be applied and your wallet will be credited.
        • No cash balance will be given as change.
        • The WiCode cannot be replaced if lost or stolen.
        • Individual Mr D Food WiCodes will be available in denominations of either R100 (One Hundred Rand) or R250 (Two Hundred Rand) only, up to the value of the reward allocation. 
        • Only one individual Mr D Food WiCode may be used per purchase.
        • Should the Mr D Food order be more than the value of an individual Mr D Food WiCode, the participant will be required to pay in the difference of the cost.
        • The participant will be required to download the Mr D Food app to use this Reward.
        • All Mr D Food orders need to be placed via the Mr D Food App, no telephonic orders will be permitted.
        • A delivery fee will be charged on all orders.
        • Mr D Food WiCode cannot be exchanged for cash.
        • Mr D Food WiCode are subject to Mr D Food’s regular terms and conditions (https://www.mrdfood.com/terms), which are subject to change, unless otherwise specified in this section. 
    5. A prize cannot be exchanged for cash and cannot be enjoyed in another form and/or at a different date other than the redemption periods noted above in the various prize excerpts. The prize non-transferable. No right to compensation exists in case of refusal of a prize. 

  6. Limitation of Liability:
    • To the extent permitted by Consumer Protection Act No 68 of 2008 (“Consumer Protection Act”) and any other applicable law:
      1. The participant hereby indemnifies the Organizer against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participants entrance to the Promotion.
      2. The Organizer excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).
      3. Save as clearly set out in the promotion specific marketing, the participant acknowledges that no warranties (express or implied) or representations have been made by the Organizer in relation to the Promotion and no liability shall arise against the Organizer as a result of any alleged breach of warranty or misrepresentation.
      4. The Organizer makes no warranty that the DGB platforms related to the promotion and  website will meet your requirements or will be uninterrupted or will be interrupted, timely or error-free or that the DGB platforms related to the promotion and website or the server(s) that makes them available are free from viruses, errors, faults or bugs.
      5. The Organizer will not be responsible for any costs associated with the registration and redemption process of the prize. 
      6. The Organizer accepts no responsibility for entries lost, misdirected, illegible, late, mutilated or altered. Entries that do not comply with these Terms and Conditions will be disqualified.
      7. Errors and omissions may be accepted at the Organizer’s sole discretion. Failure by the Organizer to enforce any of its rights at any stage does not constitute a waiver of those rights.
      8. It is the participant’s responsibility to ensure that any information provided to the Organizer is accurate, complete and up to date.

  7. General:
    1. In accordance with the confidentiality policies and practices of the Organizer, none of the entry details of any participant in this Promotion will be disclosed or used by the Organizer for any purposes other than for entry into the Promotion.
    2. The Organizer reserves the right, at any time, to verify the validity of participants (including a participant’s identity, age and place of residence) and to reject any participant who has not agreed to these Terms and Conditions. Errors and omission may be accepted at the Organizer’s sole discretion. Failure by the Organizer to enforce any of its rights at any stage does not constitute a waiver of those rights.
    3. Participants acknowledge and accept that the Organizer shall utilise a third party (the “Organizer’s authorised agent/s”) to contact the participant, in the event that the participant qualifies for the Promotion, and to arrange delivery of the prize, where applicable. In order to affect the contacting and delivery process, the Organizer’s shall provide the participant’s information to such third party.
    4. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organizer, including but not limited to technical difficulties, unauthorized intervention or fraud, the Organizer reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any participant; or (b) to modify, suspend, terminate or cancel the Promotion as appropriate, subject to the approval of relevant regulatory authorities.
    5. By participating in the Promotion, the participants agree that the Organizer and its affiliates may contact the participants via email and through social media platforms to deliver marketing communications regarding their products and promotional activities, provided that the Participants are given the opportunity to opt-out of receiving marketing communication at any time via the appropriate opt-out mechanisms provided by the Organizer for such purpose. The Organizer may also use the personal data collected from the participants as described in the Privacy Policy accessible at https://www.dgb.co.za/privacy-policy/ and that such use may include transfers to the Organizer’s affiliates and third-party service providers in any country.  Details of participants will not be used by the Organizer for DGB brand related communication should the participants opt-out to receive further communication from the Organizer.
    6. Information regarding the Promotion that is published on authorized advertising material will also form part of the Terms and Conditions of the Promotion. In the event however, of any conflict between the advertising material and these Terms and Conditions, these Terms and Conditions will prevail.  

  8. Consumer Protection Act:
    1. To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, no provision of the Terms and Conditions are intended to contravene the applicable provisions of the Consumer Protection Act, and therefore all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the Consumer Protection Act are complied with.
